Terms of Service
These Terms of Service ("Terms") govern your use of ecokeeper ("the App," "we," "us," or "our"). By accessing or using the App, you agree to these Terms.
1. Use of the App
You may use the App only in compliance with these Terms and applicable law. You are responsible for your account, your activity in the App, and any content or data you choose to submit through the App.
2. Image Features
The App may allow you to capture or select photos for local journal entries and may allow you to intentionally submit images for sunlight-reading analysis. You retain your rights in your images, but you give us a limited permission to receive, transmit, and process images you intentionally submit to our service only as needed to provide the current image-based functionality you request.
You represent and warrant that you have the necessary rights, permissions, and consents to capture, store, submit, and process any image you use with the App.
3. Acceptable Image Content
You may not use the App to capture, store, upload, submit, or process images that:
- Violate any law or regulation
- Depict or promote child sexual abuse material, sexual exploitation, or any abusive sexual content
- Are hateful, harassing, threatening, abusive, or depict graphic violence
- Invade someone else's privacy, are non-consensual, or are deceptive or misleading in a way that harms others
- Infringe or misappropriate intellectual-property, publicity, privacy, or other rights belonging to another person or entity
- Are otherwise exploitative, unlawful, or not authorized for you to submit or process through the App
4. Enforcement
We may refuse to process image-based requests, limit access to image features, suspend accounts, or terminate access to the App if we believe these Terms have been violated or if doing so is necessary to protect users, the service, or third parties.
5. Privacy
Our collection and handling of personal information is described in our Privacy Policy.
6. Availability and Changes
We may change, suspend, or discontinue all or part of the App at any time. We may also update these Terms from time to time. If we make changes, we will update the Effective Date above. Your continued use of the App after any update means you accept the revised Terms.
7. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee that the App will be uninterrupted, error-free, or suitable for every purpose.
8. Limitation of Liability
To the maximum extent permitted by law, ecokeeper and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or business opportunities arising out of or related to your use of the App.
